A few months ago, Elon Musk filed a lawsuit against Microsoft-backed OpenAI, but he subsequently dropped it. Well, it doesn’t look like Elon Musk is done picking on its former baby, as he has filed yet another lawsuit against OpenAI. This time, it’s for a bit of an odd reason.
If you recall, Musk tried to sue OpenAI a few months before on the grounds that the company betrayed its original vision of providing AI for the benefit of humanity. He also remarked on the fact that ChatGPT’s source code isn’t public and the fact that the company has such a close partnership with Microsoft.
During the lawsuit, OpenAI revealed some emails pointing to some severe hypocrisy on Musk’s part. The emails revealed that, when he was part of OpenAI, he agreed that the source code should be private and that it should be a sub-brand of Tesla. The lawsuit withered away unceremoniously.

This is still a developing story. This case hasn’t made it to court just yet. So we don’t know if there will even be a legal showdown. We’ll keep you updated with more information.
The last lawsuit was a bit of a mess, but Elon’s lawyer, Marc Toberoff, wants us to know that they mean business this time. “This is a much more forceful lawsuit,” he said to The New York Times. According to the lawsuit, two of OpenAI’s founders, Sam Altman and Greg Brockman, “manipulated Musk into co-founding their spurious non-profit venture.” They apparently promised that their AI would be a safe and honest alternative to other models in development. It sounds a bit like Elon Musk playing the victim here.
Also, the suit claims that the company’s non-profit structure is what roped him and others into the company. It refers to it as “Altman’s long con.”
The lawsuit pushes hard this time, even going as far as to say that OpenAI defrauded Musk while breaking federal racketeering laws. Lastly, the lawsuit mentions OpenAI’s relationship with Microsoft. It claims that Microsoft won’t have access to OpenAI’s core technology once it achieves AGI, as per their contract.
